Discrecionalidad Judicial

Abstract

[ES] En este presente trabajo, trato la discrecionalidad judicial, de opción de decidir y calificar del juez ante la Ley, como límite actuante ésta. Como limite a la indeterminación normativa de algunos casos que han llevado a opciones diferentes siempre que el texto legal aplicable cumpla las características del hecho concreto. Además del análisis de los principios y reglas de Derecho que nos servirán para poder llegar a un objetivo final de estudio por el cual obtendremos un enfoque de la discrecionalidad judicial ante la Ley, de la aplicación del juez de la Ley como objetivo final tras las fases adecuadas. No solo constará de una parte de análisis teórico sino que, como bien es sabido para acabar entendiendo la teoría indicare un caso real, analizando determinadas sentencias jurídicas que serán de comprensión de nuestro tema.

[EN] In this present Thesis, I cover judicial discretion, the option to decide and qualify the judge before the Law, being it the acting limit. As a limit to the normative indeterminacy of some cases that have led to different options as long as the applicable legal text meets the characteristics of the specific fact. In addition to the analysis of the principles and rules of law that will help us reach a final aim of study through which we will obtain an approach to judicial discretion before the law, of the application of the law by the judge as a final goal after the adequate phases . It will not only consist of a theoretical analysis but, as it is well known, for a better understanding of the theoretic content I will indicate a real case, analyzing certain legal sentences that will be of understanding of our subject.
