RESPONSABILIDAD CIVIL EN ACTIVIDADES DEPORTIVAS DE RIESGO

Abstract

[ES] Este trabajo versa sobre la relación actual que existe entre la responsabilidad civil y el deporte, más concretamente los deportes de riesgo. Estos deportes de riesgo son cada día más practicados y por desgracia son cada vez mayores el número de daños que se producen al practicarlos y en muchas ocasiones, no solo producen lesiones, sino que provocan el fallecimiento de muchas personas puesto que el riesgo es mayor que en cualquier otro deporte. El derecho, como instrumento regulador de nuestra sociedad, ha ido evolucionando y han ido surgiendo nuevos instrumentos que regulan esta materia, sin ir más lejos, la ley 10/1990, de 15 de Octubre, del Deporte, la cual desarrollaremos a los largo de este trabajo. Esta y otras leyes, así como el análisis de casos reales y el estudio de los términos y elementos de la responsabilidad civil nos ayudará a entender la relación que existe entre estos dos términos.

[EN] This work is about the current relationship between civil responsibility and sport, more specifically risk sports. These risk sports are more and more practiced every day and unfortunately the number og damages that happen when practicing them is increasing and, in many cases, they not only produce injuries, but also cause the death of many people, since the risk is greater than in any other sport. The law, as a regulatory instrument of our society, has been evolving and new instruments have been emerging that regulate this matter, without going any further, Law 10/1990, of Octuber 15, on Sport, which we will develop throughout this work. This and other laws, as weel as the analysis of real cases and the study of the terms and elements of civil liability will help us to understand the relationship that exists between these two terms.
