Responsabilidad Civil derivada de la ocultación de la verdadera paternidad

Abstract

[ES] El tema de estudio del trabajo es la responsabilidad civil que puede derivarse de la ocultación de la verdadera paternidad de los hijos en el matrimonio. Se va a ver es como la infidelidad no supone una causa para que se produzca la indemnización, debido a la reforma del Código Civil mediante la Ley 15/2005 por la que se suprimen las causas en las que fundamentaban los cónyuges la separación o el divorcio. En cambio, existen algunas situaciones concretas de infidelidad que conllevan consecuencias jurídicas al cónyuge y puede desembocar en daño moral e incluso patrimonial, se trata de la ocultación de la verdadera paternidad. La conclusión que se saca, es que no existe una solución clara para el tema y el Tribunal Supremo tampoco se ha pronunciado sobre el fondo del asunto, por lo que el debate sobre este tipo de indemnización sigue abierto en la actualidad.

[EN] The theme to study of this research work is the civil responsibility that can be derived from the concealment of the true paternity of the children in the marriage. We will see how infidelity is not a reason for compensation, this is due to the Civil Code reform by means of Law 15/2005, which abolishes the reason on which the spouses based separation or divorce. However, there are some specific situations of infidelity that have legal consequences for the spouse and it can lead to moral and even patrimonial damage, this is the concealment of true fatherhood. The conclusion drawn is that there is no clear solution for the subject and the Supreme Court has not ruled on the merits of the matter, so the debate on this type of compensation is still open today.
