Régimen jurídico, estatutario y reglamentario de las hermandades y cofradías

Abstract

[ES] En el sistema diocesano de España habitan un notable número de hermandades y cofradías constituidas como uno de sus elementos con mayor relevancia que configuran la vida, estructura y funcionamiento de la Santa Iglesia católica. Bajo la rúbrica de asociaciones de fieles, el Código canónico de 1983 regula estas agrupaciones de creyentes que amparados por el derecho de asociación se establecen como personas jurídicas, públicas o privadas, para la consecución de unos fines de naturaleza eclesiástica. El objetivo de este trabajo es conocer y profundizar en la regulación jurídica de las asociaciones de fieles en su consideración como persona por el Derecho canónico y civil del Estado, así como el régimen estatutario y reglamentario común de las hermandades y cofradías. [EN] A considerable number of fraternities and brotherhoods inhabit in the Spanish diocesan system, defining the life, structure and functioning of the Catholic Church. The 1983 Code of Canon Law regulates the association of the faithful in order to achieve their ecclesiastical purposes. The aim of this essay is to know the regulation of the associations of the faithful as legal persons in the Canon and Civil law, their statutory and regulatory regime.
