El matrimonio mixto entre musulmán y católica

Abstract

[ES] El presente trabajo tiene como objetivo indagar en el matrimonio mixto entre un hombre musulmán y una mujer católica. Para la celebración de estos matrimonios conforme al Derecho canónico se requiere que el Ordinario del lugar otorgue una dispensa porque hay un impedimento matrimonial de disparidad de cultos. Para que se otorgue la dispensa, primeramente tiene que haber justa causa, y antes de la celebración del matrimonio los contrayentes tienen que recibir una preparación acerca de los fines y propiedades fundamentales del matrimonio canónico y realizar unas promesas. Puede suceder que la parte católica sea un hombre y la mujer musulmana, este caso, es en el Islam donde hay más problemas para aceptar el matrimonio.

[EN] The objective of this study is to investigate the mixed marriage between a Muslim man and a Catholic woman. For the celebration of these marriages according to canon law it is required that the local Ordinary grant a dispense because there is a matrimonial impediment of disparity of cult. For granting the dispense, first it is needed to have a just cause and, before the marriage is celebrated, the intending spouses must receive a preparation about the purposes and fundamental properties of canonical marriage and make certain promises. It may happen that the Catholic side can be the man, while the woman is a Muslim woman. But, in this case, it is in the Islam where there are more problems to accept marriage.
