El derecho de defensa en el proceso penal

Abstract

[ES] El presente trabajo tiene como fin analizar el conjunto de garantías que presenta el derecho de defensa, configurado como el derecho fundamental o garantía judicial del “debido proceso”, que se le reconoce a toda persona a quien se le atribuye un hecho punible, interviniendo en todas las fases del proceso penal y además, en todos los órdenes jurisdiccionales. Es necesario que sea reconocido en el marco de un proceso penal por la trascendencia que presenta y para que cualquier persona pueda defenderse de los hechos que se le imputan, y se le pueda garantizar una serie de garantías constitucionales como el derecho a ser informado y oído, a guardar silencio, a no declarar contra sí mismo, a acceder a los elementos de las actuaciones, entre otros.

[EN] The present work having as a goal to analyze the guarantees that the right of defence presents, configured as the fundamental right or as the legal guarantee of “due diligence”, which is a recognized right for every person who commits a punishable act, such a right being involved in all the stages of the criminal proceedings and in all the jurisdictional divisions. It is necessary to be recognized within the framework of a criminal proceeding due to its importance and in order to any person be able to defend himself or herself from the offences of which he or she is accused and he or she may be guaranteed a variety of constitutional guarantees such as the right to be informed and to be heard, the right to silence, the right against self-incrimination, the right to accede to the action items, among others.
