EL RÉGIMEN DE LA SEGUNDA OPORTUNIDAD EN EL CONCURSO DE ACREEDORES

Abstract

[ES] En este trabajo vamos a tratar el tema sobre el régimen de la segunda oportunidad en el concurso de acreedores. Vamos a tratar diversos temas como: Quien puede solicitar dicho régimen, y los requisitos para ellos, supuestos en los que va a ser imposible aplicar dicho acuerdo extrajudicial para el pago de la deuda, la forma de iniciar el proceso, la forma de concluirlo y la duración de las diversas fases que forman dicho sistema resolutivo de conflictos. Además veremos diversos temas como los requisitos para poder ser mediador concursal, sus formas de pago, el estatuto por el que se rige, la forma de nombramiento y las funciones que este posee a lo largo del proceso. Por último se harán alusión al concurso consecutivo, el del beneficio del pasivo insatisfecho. Y por último veremos una referencia a los formularios los cuales hay que redactar para iniciar y tramitar el proceso.

[EN] In this paper we will discuss the issue of the regime of second chance in the bankruptcy. We will discuss various topics such as: Who can request such a scheme, and the requirements for them, assumptions in which it will be impossible to apply said extrajudicial agreement for the payment of the debt, the way to initiate the process, the way to conclude it and the duration of the various phases that they form such a conflict resolution system. In addition we will see various issues such as the requirements to be a bankruptcy mediator, payment methods, the statute by which it is governed, the manner of appointment and the functions that it has throughout the process. Finally, mention will be made of the consecutive contest, that of the benefit of the dissatisfied liability. And finally we will see a reference to the forms which must be written to start and process the process.
