La libertad religiosa ante el Tribunal Constitucional

Abstract

[ES] El objeto del presente trabajo es la sistematización de la jurisprudencia del Tribunal Constitucional sobre la libertad religiosa y la situación que existe en España, reflejado en diversas sentencias y Autos desde sus principios. Por esta razón, nos basaremos sobre las resoluciones del Tribunal Constitucional y la doctrina que trata este derecho fundamental, es decir, qué es la libertad religiosa para el Tribunal, como está limitado y cuáles son sus manifestaciones esenciales. También abarca la asistencia religiosa en diferentes ámbitos, como en las Fuerzas y Cuerpos de Seguridad del Estado y como en la Educación, además de la problemática que ha ocasionado en la sociedad y como lo ha entendido el Tribunal. El valor más significativo de este trabajo será el estudio objetivo de las resoluciones del Tribunal Constitucional español.

[EN] The purpose of this paper is the systematization of the jurisprudence of the Constitutional Court on religious freedom and the situation that exists in Spain, reflected in various judgments and Autos from its beginnings. For this reason, we will base ourselves on the Constitutional Court's resolutions and the doctrine that deals with this fundamental right, that is, what religious freedom is for the Tribunal, how it is limited and what its essential manifestations are. It also covers religious assistance in different areas, such as in the State Security Forces and Bodies and as in Education, in addition to the problems it has caused in society and as the Court has understood. The most significant value of this work will be the objective study of the resolutions of the Spanish Constitutional Court.
