ADOPCIÓN NACIONAL: ¿ADMINISTRATIVIZACIÓN O JUDICIALIZACIÓN?

Abstract

[ES] La adopción ha evolucionado mucho a lo largo de la historia, y para su com-prensión es necesario determinar cuál es su finalidad, y cómo proteger esa finalidad mediante un sistema que vele por encima de todo por el interés supe-rior del menor. Sobre todo actualmente, después de las importantes reformas que ha sufrido el régimen de la adopción nacional, es necesario concretar hasta dónde es decisión de los jueces la constitución de la adopción, y hasta dónde llega el poder de las entidades administrativas, que juegan un papel fundamen-tal en el procedimiento.

[EN] Adoption has evolved over the course of history, and for its understanding it is necessary to establish what its purpose is and how to protect that purpose by a system that look, above all, after the superior interest of the child. Nowadays mainly, after important change that the regimen of adoption has undergone, we need to elucidate how far the power of decisión of judges and of adminis-trative entities go, which play an essential function on the procedure.
