LA MODIFICACIÓN DE LA LEY 52/2007, DE 26 DE DICIEMBRE, DE MEMORIA HISTÓRICA A TRAVÉS DEL REAL DECRETO-LEY 10/2018, DE 24 DE AGOSTO. POSIBLE SUSPENSIÓN CAUTELAR DE LA EJECUTIVIDAD Y DE LOS ACTOS ADMINISTRATIVOS DERIVADOS DEL MISMO

Abstract

[ES] Este trabajo trata sobre la posible suspensión cautelar de la ejecutividad y de los actos administrativos derivados a modificación de la Ley 52/2007, de 26 de diciembre, de Memoria Histórica a través del Real Decreto-ley 10/2018, de 24 de agosto. Se realizará un estudio minucioso sobre los aspectos de las medidas cautelares en orden contenciso-adminsitrativo junto con el análisis del marco de los actos administrativos y Reales Decretos-Ley y su posible suspensión.

Este estudio está enfocado en dar a conocer esta figura, que con la aprobación de este Acuerdo de Consejo de Ministros será un tema de actualidad. El auto se someterá a un análisis por el que se le deniegan a la familia Franco las medidas cautelares que solicitan para la suspensión del Acuerdo de Consejo de Ministros, ya que se argumenta que se vulneran los derechos de la familia.

[EN] This work deals with the possible precautionary suspension of the executive and the administrative acts derived from the modification of Law 52/2007, of December 26, of Historical Memory through Royal Decree-law 10/2018, of August 24. A thorough study will be conducted on the aspects of precautionary measures in content-administrative order together with the analysis of the framework of administrative acts and Royal Decrees-Law and its possible suspension.

This study is focused on raising awareness of this figure, which with the approval of this Agreement of the Council of Ministers will be a topical issue. The order will undergo an analysis for which the Franco family is denied the precautionary measures requested for the suspension of the Council of Ministers Agreement, since the rights of the family are violated.
