LA PROTECCIÓN DE DATOS PERSONALES COMO UN DERECHO FUNDAMENTAL EN LA ERA DE LA TECNOLOGÍA Y SU PROTECCIÓN EN EL ORDENAMIENTO JURÍDICO ESPAÑOL

Abstract

[ES] La finalidad de este trabajo es la de ser un instrumento de ayuda que contribuya a aclarar y superar las dificultades que pudiera generar el derecho a la protección de datos personales, así como el reciente Reglamento General de Protección de Datos, su aplicación en Europa y especialmente en España. Para ello, recorreremos la historia del derecho a la protección de datos desde sus primeras referencias normativas hasta la actualidad, para comprender el fundamento de la protección de datos y las herramientas de análisis y control que proporciona el Reglamento para garantizar la seguridad o minimizar los riesgos de los datos personales.

[EN] The purpose of this work is to be an aid instrument that helps clarify and overcome the difficulties that may arise from the right to personal data protection, as well as the recent General Data Protection Regulation, its application in Europe and especially in Spain. To do this, we will go through the history of the right to data protection from its first normative references to the present, to understand the basis of data protection and the analysis and control tools provided by the Regulation to guarantee safety or minimize risks of personal data.
