LA RESPONSABILIDAD PATRIMONIAL DE LA ADMINISTRACIÓN PÚBLICA EN EL ÁMBITO SANITARIO

Abstract

[ES] El siguiente trabajo versará sobre la responsabilidad patrimonial de la Administración Pública, siendo una de las instituciones jurídicas de gran importancia en nuestro ordenamiento debido a la manifestación del Estado de Derecho, así como su presencia habitual en la vida cotidiana del individuo, ya que este sistema trata la relación que tiene la ciudadanía con la Administración Pública y la protección de los derechos del ciudadano frente a la vulneración por parte de la Administración. En el ámbito sanitario a principios del siglo pasado podíamos decir que la responsabilidad patrimonial no existía, y a día de hoy es indudablemente un gran núcleo de reclamaciones judiciales, debido a ello se produce un aumento en el número de reconocimientos indemnizatorios a los administrados, cifras que no paran de crecer cada año, por ello resulta de interés el estudio de esta figura, las características, supuestos en materia sanitaria, así como su evolución jurisprudencial.

[EN] The following work will deal with the patrimonial responsibility of the Public Administration, being one of the legal institutions of importance in our legal system due to the manifestation of the Rule of Law, as well as its habitual presence in the life of the individual, since this system It deals with the relationship that citizens have with the Administration and the protection of the rights of the citizen against the violation by the Administration. In the health field at the beginning of the last century we could say that the patrimonial responsibility did not exist, and today is undoubtedly a large core of judicial claims, due to this there is an increase in the number of compensation recognitions to those administered, figures that they don’t stop growing every year, therefore it’s of interest the study of this figure, the characteristics, assumptions in health matters, as well its jurisprudential evolution.
