LA PROTECCION Y LA AUTONOMIA DE LA PERSONA DISCAPAZ EN EL AMBITO CIVIL Y LABORAL

Abstract

[ES] El objetivo principal de este trabajo Fin de grado es conocer la problemática de las personas con discapacidad y el cambio paradigmático de su tratamiento jurídico a raíz de la ratificación por España en el 2008 de la Convención Internacional de los Derechos de las personas con discapacidad. Para ello, dicho trabajo, en primer lugar hace un recorrido de su evolución conceptual y jurídica (ámbito internacional, nacional, autonómico), centrándose sobre todo en la regulación jurídica de la protección y promoción de la autonomía del discapaz, tratando la modificación de su capacidad de obrar y las figuras jurídicas de protección. Y en segundo lugar, aborda el tratamiento jurídico-social del discapaz en el ámbito laboral, centrándose en las mujeres con discapacidad y el papel de las fundaciones en este sector.

[EN] The main objective of this Work End of Degree is to understand the problems of people with disabilities and the paradigmatic change in their legal treatment following the ratification by Spain in 2008 of the International Convention on the Rights of Persons with Disabilities. In order to achieve this, this work first of all reviews its conceptual and legal evolution (international, national, autonomous), focusing above all on the legal regulation of the protection and promotion of the autonomy of the disabled, trying to modify their capacity to act and the legal protection figures. And secondly, it deals with the legal-social treatment of the disabled in the workplace, focusing on disabled women and the role of foundations in this sector.
