Resumen
[ES] El presente Trabajo Final de Grado muestra un estudio de las competencias que poseen los Municipios en materia de telecomunicaciones, teniendo en cuenta que es una competencia atribuida en exclusiva al Estado en el artículo 149 de la Constitución española.
Debido al acelerado avance de la tecnología y consecuentemente de las telecomunicaciones, esta una materia que se ha modificado en numerosas ocasiones. Antes del año 1996, las telecomunicaciones se calificaron como servicios públicos y el Estado poseía la competencia absoluta. En la actualidad, el Estado impone obligaciones a los operadores del mercado de libre competencia, que son los encargados de la prestación del servicio. La nueva Ley General de Telecomunicaciones 9/2014 trata de dilucidar los conflictos que devienen de las competencias que poseen las diferentes Administraciones Públicas; el Estado, las Comunidades Autónomas y los Entes locales, estableciendo que, en caso de conflicto, la competencia del Estado prevalecerá sobre las demás.
[EN] The actual Final Degree Project shows a study of the competency of the local government have in telecommunications subject, taking into account that it is an exclusive competence of the State in article 149 of the Spanish Constitution. Due to the accelerated progress of technology and consequently of telecommunications, it is a subject that has been modified on numerous occasions. Before 1996, telecommunications were classified as public services and the State had absolute competency. At present, the State imposes obligations on operators of the free competition market, which are responsible for providing the service. The new General Telecommunications Law 9/2014 seeks to elucidate the conflicts that arise from the competency held by the different Public Administrations; the States, the Autonomous Communities and the local government, establishing that, in case of conflict, the competency of the State will prevail over the others.
