LOS PROCESOS SOBRE FILIACIÓN, PATERNIDAD Y MATERNIDAD: LA ACCIÓN DE IMPUGNACIÓN

Abstract

[ES] Los procesos civiles especiales y en concreto los procesos relacionados con la filiación, paternidad y maternidad tienen una gran transcendencia. Por un lado, nos permiten determinar la filiación, pero a su vez ésta podrá ser impugnada cuando los sujetos legitimados y bajo las circunstancias oportunas interpongan las acciones correspondientes. Además no todos los procesos tendrán las mismas características ya que se debe diferenciar entre procesos matrimoniales y no matrimoniales. De ésta forma, el estudio de la filiación y de los medios probatorios de ésta ha recobrado vital importancia en la nueva legislación en material procesal aunque sean inevitables las alusiones al Código Civil.

[EN] The special civil processes and in particular the processes related to filiation, paternity and maternity have a great transcendence. On the one hand, they allow us to determine the filiation, but at the same time, it may be challenged when the legitimated subjects under the concrete circumstances interpose the corresponding actions. In addition, not all processes will have the same characteristics as it is necessary to differentiate between maritial and non-marital processes. In this way, the study of affiliation and the tests of it have regained vital importance in the new procedural legislation although the allusions to the Civil Code are inevitable.
