USURA, USURAE. PROBLEMÁTICA DEL INTERÉS EN EL DERECHO ROMANO.

Abstract

[ES] Con este estudio sobre la usura y su problemática en el Derecho Romano, podemos comprobar como el interés ha ido evolucionando y adaptándose a los tiempos y características de cada época, desde estar totalmente prohibidas, a estarlo sólo para algunos sujetos y luego regularse para todos, pero atiendo a una serie de requisitos y circunstancias. Además, también vamos a encontrar un estudio de los conceptos y precisiones terminológicas que acompañan a la usura, y cómo ha ido calando en la sociedad este término. A lo largo de este trabajo vamos a encontrar mencionados a muchos autores, algunos coincidiendo y otros oponiéndose entre ellos, pero todos ellos resultan importantes para el esclarecimiento de este tema, como; Justiniano, San Ambrosio, Gayo, … Al final del trabajo vamos a descubrir cómo ha repercutido en la actualidad la usura y cómo es en nuestro día a día ese interés.

[EN] With this study on usury and its problems in Roman Law, we can see how interest has evolved and adapted to the times and characteristics of each era, from being totally forbidden, to be only for some subjects and then regulated for all, but I attend to a series of requirements and circumstances. In addition, we will also find a study of the terminological concepts and precisions that accompany usury, and how this term has been penetrating in society. Throughout this work we will find mentioned many authors, some agreeing and others opposing each other, but all of them are important for the clarification of this topic, such as; Justiniano, San Ambrosio, Gayo, ... At the end of the work, we will discover how this interest has affected today and how this interest is in our day-to-day life.
