Abstract

[ES] El presente trabajo habla de Las Teoría Interpretativas del Derecho aplicadas al tema de la indemnización por daños derivados de la infracción de normas de la competencia. En él vamos a poder leer las teorías de los principales autores y la aplicación al derecho de hoy día. Vamos a tratar, concretamente, el tema del cártel de los camiones. Un tema novedoso pero que a su vez cuenta con muy poca jurisprudencia al igual que con un bagaje escaso en cuanto a normas, aplicación, etc. Vamos a analizar las teorías de Kelsen, Hart y Dworkin y, a partir de este análisis, vamos a pasar a ver una serie de sentencias y su interpretación conforme a las Teorías del Derecho.

[EN] This paper talks about The Interpretative Theories of Law applied to the subject of compensation for damages arising from the infringement of competition rules. In it we will be able to read the theories of the main authors and the application to law today. We are going to deal specifically with the issue of the lorry cartel. This is a novel subject, but in turn it has very little jurisprudence as well as a scarce background in terms of rules, application, etc. We are going to analyze the theories of Kelsen, Hart and Dworkin and, from this analysis, we are going to see a series of sentences and their interpretation according to the Theories of Law.
