CUESTIONES LEGALES CONTROVERTIDAS EN VIOLENCIA DE GÉNERO

Abstract

[ES] El presente trabajo pretende mostrar, no sólo la importancia de la erradicación de la Violencia de Género, sino que, mientras esta sea una realidad, aún existe la necesidad de comprender las posturas en las que se encuentran las víctimas. Concretamente, mediante el análisis de dos preceptos (art. 416 de la LECrim y 158 del C.C.) se pretende mostrar la importancia de dos cuestiones. Por un lado, la dificultad que supone para los operadores jurídicos continuar satisfactoriamente con un procedimiento cuando la víctima se acoge a la dispensa a no declarar, así como, las consecuencias directas que conllevan para ellas. Por otro lado, la utilidad práctica de exponer el beneficio que supone para los menores víctimas que se adopten medidas de protección adecuadas para cada caso concreto, teniendo en cuenta que el interés del menor prevalece por encima del de sus progenitores.

[EN] The present work tries to show, not only the importance of Gender Violence eradication. It tries to demonstrate there is still a need to understand the positions in which the victims are. Specifically, through the analysis of two precepts (art. 416 of the LECrim and 158 of the C.C.) it is intended to show two important aspects. On one hand, the difficulty for legal operators to continue satisfactorily with a procedure when the victim avails himself of the dispensation to not declare, as well as the direct consequences they involve for them. On the other hand, the practical interest of exposing the benefit that it implies to minor of age victims to adopt appropriate protection measures for their situation, in search of their parents. It should take into account the interest of the child prevails over their parents interest.
