CIRCUNSTANCIAS MODIFICATIVAS DE LA RESPONSABILIDAD PENAL

Abstract

En primer lugar, voy a explicar brevemente las distintas circunstancias modificativas de la responsabilidad penal recogidas en nuestro código penal. Después, voy a dedicar el resto del trabajo a profundizar sobre la reincidencia, contenida en el artículo 22.8 CP, puesto que es una de las figuras que más problemas ha planteado tanto en la doctrina como en la jurisprudencia. Con respecto a ésta voy a analizar cuáles son sus caracteres, elementos, efectos, además de otras cuestiones de especial relevancia. Por último, a través de la sentencia 150/91 del Tribunal Constitucional, voy a proceder a examinar la inconstitucionalidad de esta agravante en relación con numerosos principios y derechos de la Constitución Española y también desarrollaré las diferentes posiciones doctrinales que han surgido sobre este tema.

In the first place, I will briefly explain the different circunstances modifying the criminal responsability contained in our criminal code. Next, I will dedícate the rest of the work to delve into recidivism, contained in article 22.8 CP, since it is one if the figures that has raised the most problems in both doctrine and jurisprudence. With regard to this, I am going to analyze what are its characters, elements, effects, as well as other issues of special relevance. Finally, through ruling 150/91 of Constitucional Court, I will proceed to examine the unconstitutionality of this aggravation in relation to numeus principles and rights of the Spanish Constitution and I will also develop positions that have emerged on this issue.
