La Intervención Judicial en el Arbitraje

Abstract

En el presente trabajo se abordará la estructura que adoptan los diferentes instrumentos del procedimiento arbitral cuando para su efectivo desarrollo se hace necesaria la intervención judicial y cómo se conjugan potestades arbitrales y judiciales. En efecto, puede requerirse la intervención judicial tanto con carácter previo al inicio del arbitraje -así en lo referido a la designación arbitral-, como durante su tramitación -en lo concerniente a medidas cautelares-, incluso posteriormente a la emisión del laudo -en lo que se refiere a la ejecución forzosa del laudo o al reconocimiento de laudos extranjeros, cuestión esencial dada la dimensión internacional del arbitraje-. Tan solo enriquecerá el procedimiento arbitral una intervención judicial que complete con su competencia la que carece el árbitro, sin que ello implique un arbitraje judicializado.

This paper will address the structure adopted by the different instruments of arbitration when judicial intervention is necessary for effective development and how arbitral and judicial powers are combined. Indeed, judicial intervention may be required botb in advance at the start of arbitration -so with regard to the arbitral appoinment­ and during their processing -conceming precautionary measures­ including subsequent to the insurance of de award- as far regard to the enforcement of the award or the recognition of foreign awards, critica!issue given de intemational arbitration dimention. Only will enrich the arbitration proceedings a judicial intervention to complete their competition with lacks the referee, whiteout causing any jucialized arbitration.
