Contrato de compraventa

Abstract

[ES]El contrato de compraventa es indudablemente el instrumento jurídico que más se lleva a cabo para obtener la propiedad de las cosas según nuestro Código en el Título IV de su libro cuarto. En este trabajo vamos a ver en qué consiste en general el contrato de compraventa, y vamos a ver la parte tanto del comprador como del vendedor. El artículo que principalmente habla del contrato de compraventa es el 1.445 Cc, que dispone que una de las partes estar obligada a entregar una cosa determinada y la otra parte está obligada a pagar por la cosa un cierto precio, ya sea dinero o una señal que lo represente. Hoy en día, la compraventa tiene un papel muy importante porque a través de la misma se puede adquirir, deshacer y obtener la posesión legal de las cosas, entendiendo el término cosa como objeto de la compraventa.

[EN]The buying and selling contract is, without doubt, the most useful legal instrument to obtain the property of the objects according to our Civil Code, IV title, and fourth book. In this work we will see what the buying and selling contract consist of and, also, the buyer and seller´s roles. The article which talks principally about the buying and selling contract is the 1.445 Cc. This article disposes that one part is obligated to deliver a certain object and the other one is obligated to pay a price in order to obtain it. The payment can be though money or a signal which represent it. Nowadays, the buying and selling contract has got a very important role because thought it, the object can be acquired, removed and also acquired legally.
