La ocupación temporal y su indemnización

Abstract

[ES]En el presente Trabajo Final de Grado, se pretende abordar la ocupación temporal de terrenos la cual se encuentra regulada por le Derecho Administrativo. Ésta figura se presenta tanto en España como en otros países, donde en ocasiones se propician una serie de problemáticas debido a su delimitación jurídica dentro del ámbito institucional de la expropiación y las distintas controversias que pudieren surgir. Las situaciones de ocupación temporal serán examinadas conforme a la legislación vigente de nuestro Derecho. Por otra parte serán desarrolladas las diversas posibilidades que tienen los afectados de acceder a las indemnizaciones de las Administraciones Públicas cuando se vean en la situación de limitación de su propiedad dentro de unos límites. Se expondrán algunas sentencias donde se muestra la aplicación de la ley con respecto a las diversas situaciones posibles y las soluciones que se dan a las mismas.

[EN]In this Final Grade Work, will present address refering to the temporary occupation of land which is regulated by Administrative Law. This figure is presented both in Spain and in other countries, where sometimes leads to a series of problems due to its legal delimitation within the institutional environment of the expropriation and the different controversies that may arise. Situations of temporary occupation will be reviewed in accordance to the current legislation of our Law. On the other hand will be developed the various possibilities that have affected access to compensantion from Public Administrations when they are in the situation of limitation of your property within limits. Some sentences will be presented which shows the application of the law with respect to the various possible situations and the solutions that are given to them.
