Ley 39/2015 de procedimiento administrativo en relación a los ciudadanos y su enfoque parcial en la administración local

Abstract

[ES]La aprobación de una nueva Ley de Procedimiento Común es un acontecimiento crucial para el Derecho Administrativo. Tuvimos una pionera en el siglo XIX, impulsada por Gumersindo de Azcárate, dos en el siglo XX (en 1958 y 1992) y vemos ahora aparecer la primera del siglo XXI, consciente de la importancia. Además, la Ley 39/2015, pretende cambiar la forma de actuar de la Administración. Desde la reflexión y el trabajo a tiempo real, se pone un ojo a las novedades del Procedimiento Administrativo y otro atento a la praxis en el contexto de la Administración local. Se comienza abordando un estudio teórico sobre los antecedentes legislativos, para dar paso a otras cuestiones a analizar de la reforma. A modo de conclusión, se tratarán los comentarios positivos y las propuestas críticas. Inevitable la dedicación investigadora para abordar la Ley y el mimo desde el prefacio hasta la última resolución anexa.

[EN]The adoption of a new Law of Common Procedure is a crucial event for the Administrative Law. We had a Pioneer in the 19th -century, promoted by Gumersindo de Azcárate, two in the 20th-century (in 1958 and 1992) and we see now the first one appears in the 21stcentury, aware of the importance. In addition, the Law 39/2015, tries to change the way of acting of the Administration. From the reflection and the work, it puts on an eye to the Law of Administrative Procedure and other eye is attentive to the practice in the context of the local Administrative. A theorical study starts by being approached on the legislative precedents, to the general beginning and others points of analyzing. Like conclusion, there treat each other positive comments and the critical offers. Unavoidable the investigative dedication to approach the Law and the caress from the preface to the last annexed resolution.
