Derecho a la educación y minorías

Abstract

[ES] Este trabajo trata sobre el derecho a la educación como derecho humano y fundamental, ya que está considerado como derecho inherente a todas las personas. Otro concepto de estudio es la globalización, que expreso de manera breve. Lo enmarco en un contexto internacional, europeo y nacional en el caso de España, donde se hace mayor hincapié y un estudio detallado de los problemas que se dan. Hago uso de las diferentes normas jurídicas y manuales que regulan este derecho como la Declaración Universal de Derechos Humanos. Por otro lado, se estudia la multiculturalidad y se desarrollan los conceptos de comunidad indígena, minoría religiosa y las dificultades de accesibilidad de las mismas a la educación. Por último, se utiliza la Ley de Libertad Religiosa para comprobar la situación de la libertad religiosa y en el ámbito educativo. [EN] This work is about the right to education as a human and fundamental right, considering that judge what inherent right to all people. Other concept is the globalization, that I show briefly. I delimit in a context international, european and national in the case of Spain, where it prepare more emphasis and a detailed study of the problems that exist. I use the different legal norms and reference manual that regulate this right such as The Universal Declaration of Human Rights. In the other hand, it is studied the multiculturalism and it is carry out the concepts of the indigenous community, religious minority and the difficults of accesibility from the same to the education. Finally, I use the Religious Freedom Organic Law to check the situation of the religious freedom and in the educational field.
