La crisis económica y su incidencia en la reconfiguración de las administraciones públicas

Abstract

[ES] Este Trabajo Fin de Grado analiza la crisis económica sufrida en España desde 2008 y su incidencia en la reconfiguración de las Administraciones Públicas, poniendo especial énfasis en cómo dicha crisis y reformas, han afectado a las Administraciones Locales. En primer lugar, se llevará a cabo un recorrido de los inicios de la crisis económica-financiera desde 2008, exponiendo cuales fueron los motivos que dieron origen a la misma y los problemas que propiciaron. Esta primera parte, servirá de basamento para explicar su afección en las administraciones públicas y las decisiones adoptadas encaminadas a acabar con los problemas administrativos. Seguido de esto y antes de afrontar la reforma de las Administraciones Locales, abordaremos la Ley Orgánica 2/2012, de 27 de abril, de Estabilidad Presupuestaria y Sostenibilidad Financiera, a fin de exponer sus principales objetivos en lo concerniente a las Corporaciones Locales. En segundo lugar, una parte del trabajo se dedicará a las reformas de las Administraciones Locales, comenzando por los antecedentes de la Ley 27/2013, de 27 de diciembre, de Racionalización y Sostenibilidad de la Administración Local, seguido por los grados de aplicabilidad de la LRSAL en función de una serie de criterios diferenciadores que han sido determinados a partir de la situación económica-financiera de la Entidad Local. Por último y más importante, los objetivos establecidos por la LRSAL que han dado lugar a la reforma de la Administración. En tercer lugar, se llevará a cabo un recorrido de las medidas de reforma administrativas y reconfiguración recogidas en la Ley 15/2014, de 16 de septiembre, de Racionalización del Sector Público, así como y otras medidas de reforma administrativa, que sin duda han incidido en las administraciones locales. Trazado esto, se expondrán las consecuencias tanto positivas como negativas que tales medidas y reformas han tenido sobre las administraciones locales, apoyándonos en el posicionamiento de distintos autores que han tratado sobre la materia.

[EN]This final degree project analyzes the economic crisis suffered in Spain since 2008 and its incidence in the reconfiguration of the public administrations, with particular emphasis on how this crisis and reforms have affected the local administrations. First of all, a tour of the beginnings of the economic-financial crisis be held since 2008, exposing what were the reasons that gave rise to it and the problems that propitiated to. This first part, will serve as a base to explain its condition in public administrations and adopted decisions aimed at ending administrative problems. Followed by this and before facing the reform of local administrations, we will pass the organic law 2/2012, on 27 April, of budgetary stability and financial sustainability, in order to expose its main objectives with regard to local corporations. Secondly, a part of the work will be devoted to the reform of local administrations, beginning with the history of the law 27/2013, of 27 of December, rationalization and sustainability of the Local Administration, followed by the degree of applicability of the LRSAL based on a series of differentiating criteria which have been determined based from the financial situation of the Local authority. Finally and most importantly, the objectives set by the LRSAL which gave rise to the reform of the administration. In third place, will be held a tour of the administrative reform measures and reconfiguration collected in the law 15/2014, 16 September, rationalization of the Public Sector, as well as and other measures of administrative reform, that have undoubtedly influenced the local administrations. 5 Plotting this, both positive and negative consequences that such measures will be and reforms have had on local authorities, relying on the positioning of different authors who have dealt with the matter. Finally, we will conclude with a real practical case of a local public administration, which shows the measures that have had taken after the reform of local administrations.
