LA REGULACIÓN DEL ASILO Y REFUGIO EN LA UNIÓN EUROPEA

Abstract

[ES]El objetivo del documento es el de explicar cuál es la respuesta que se ofrece desde la Unión Europea frente a la actual crisis de los refugiados, ocasionada por los conflictos bélicos existentes en Siria y Libia, entre otros países afectados. Partiendo de los principios que inspiran el espacio de libertad, seguridad y justicia y el sistema Schengen, se desarrollan los distintos instrumentos que componen el Sistema Europeo Común de Asilo, así como la jurisprudencia aportada por el Tribunal de Justicia de la Unión Europea. No obstante, el plano legislativo necesita verse apoyado por otras medidas, tales como la creación de la Agenda Europea de Migración, sin obviar la contribución del Consejo de Europa y el Tribunal Europeo de Derechos Humanos. Finalmente, España, país receptor, presenta en la regulación interna del asilo desajustes respecto de los textos internacionales, constituyendo las fronteras de Ceuta y Melilla las principales zonas de entrada.

[EN]The aim of this document is to explain the response given from the European Union facing the current refugee crisis, caused by the military conflicts both in Syria and Libya, among other affected countries. On the basis of the principles that inspire the area of freedom, security and justice and the Schengen system, the different instruments that compose the Common European Asylum System are developed, in the same way as the case-law from the Court of Justice of the European Union. Nevertheless the legislative perspective needs to be supported by other measures, such as the creation of the European Agenda on Migration, without omitting the Council of Europe and European Court of Human Rights’ contribution. Finally, Spain, receiver country, presents imbalances in the national regulation regarding the international texts; in addition, the Ceuta and Melilla’s frontiers are the main entrance zones.
