EL PROCEDIMIENTO DE LA EJECUCIÓN HIPOTECARIA

Abstract

[ES]La ejecución hipotecaria en Derecho procesal, se denomina a un procedimiento ejecutivo a través del cual se ordena la venta de un bien inmueble que estaba gravado con una hipoteca por incumplimiento del deudor de las obligaciones garantizadas con la hipoteca. Se trata de un procedimiento rápido y reglado, mediante el cual se busca de forma transparente, normalmente mediante subasta pública, hacer efectivo el valor del bien inmueble para pagar las deudas incumplidas. Una vez vendido el bien inmueble y una vez pagados los deudores hipotecarios, el dinero restante de la venta del bien se devuelve al propietario del bien inmueble (que no tiene por qué coincidir siempre con el deudor).

[EN]The mortgage execution in Procedural law, names to an executive procedure across which there is ordained the sale of a property that was burdened by a mortgage by breach of the debtor of the obligations guaranteed with the mortgage. It is a question of a rapid and ruled procedure, by means of which one seeks of transparent form, by means of public auction, to do normally effective the value of the property to pay the unfulfilled debts. Once sold the property and once paid the mortgagers, the remaining money of the sale of the good is returned to the owner of the property (who does not have why to coincide always with the debtor).
