Responsabilidad de Jueces y Magistrados: aspectos disciplinarios y penales.

Abstract

[ES]Se expone un análisis jurídico del régimen de exigencia de responsabilidad disciplinaria y penal de Jueces y Magistrados en el ejercicio de sus funciones, tomando en consideración normativa Constitucional, Orgánica y Penal. El análisis parte de la base de los principios rectores de la función jurisdiccional consagrados en la Constitución Española de 1978: independencia, inamovilidad, responsabilidad y sometimiento a la ley. Se expone la configuración del sistema de exigencia de responsabilidad judicial como respuesta a la necesidad de controlar, garantizar y salvaguardar esos principios inspiradores de la función jurisdiccional, manteniendo la integridad del sistema judicial. En el análisis se hace referencia a doctrina, jurisprudencia y normas jurídicas contenidas en la Constitución Española, en la Ley Orgánica del Poder Judicial, en el Código Penal y en otros cuerpos legales, como principal marco normativo específico regulador de la materia analizada.

[EN]This project presents a legal analysis about the requirement of Judges and Magistrates’ disciplinary and criminal responsability during the exercise of their functions, paying special attention to Constitutional, Organic and Criminal normative. The analysis is based on the principles that rule the jurisdictional function contained in the Spanish Constitution of 1978: independence, irremovability, responsability and submission to the Law. Moreover, the configuration of the system of responsability requirement is explained as a consecuence of the need of control, guarantee and protect the judicial system, maintaining its integrity. The analysis presents many references to doctrine, jurisprudence and legal rules contained in the Spanish Constitution, in the Organic Law of the Judicial Power, in the Criminal Code and other normative legal texts, as the main specific regulative texts of the analyzed matter.
