El depósito romano como categoría de contrato real y sus influencias en el Código civil español.

Abstract

[ES]El depósito tiene lugar cuando el depositante, entrega una cosa al depositario, para que la guarde y custodie. El depositario debe de restituir la cosa cuando el depositante la precise. En la época arcaica este contrato no era considerado un contrato real y, se basaba en la amistad. Este vínculo de amistad va evolucionando y adquiriendo relevancia en el ámbito jurídico. Fue al finalizar la República cuando junto con la actio in factum surge una actio in ius y de buena fe y pasó a considerarse el depósito como un contrato. Otra evolución que tuvo el contrato de depósito fue en época justinianea, debido a que una de las características del contrato es la gratuidad y en esta época no se veía mal el pago de una merces como agradecimiento para la persona que custodiara la cosa. Estas apreciaciones influirán en el depósito de nuestro Derecho civil actual.

[EN]The deposit takes place when the depositor, delivers a thing to the depositary, to keep and guard it. The depositary must return the thing when the depositor needs it. In the archaic period this contract was not considered a real contract and was based on friendship. This bond of friendship is evolving and gaining relevance in the legal field. It was at the end of the Republic that together with the actio in factum an actio in ius arose and in good faith and the deposit was considered as a contract. Another evolution that had the contract of deposit was in Justinian period, because one of the characteristics of the contract is the gratuitousness and in this time it did not look bad the payment of a merces like gratefulness for the person who would guard the thing. These assessments will influence the deposit of our current civil law.
