EL DELITO INTERNACIONAL DE LA PIRATERÍA MARÍTIMA

Abstract

[ES]A pesar de la antigüedad del delito de piratería marítima y su consideración como delito contra el Derecho de Gentes, concitando el interés de toda la comunidad internacional en su represión, no se ha logrado erradicar el mismo. El problema existente hoy en día es, no sólo la expansión cuantitativa de este fenómeno delictivo sino, desde el punto de vista cualitativo, su comisión junto con otras graves actuaciones ilícitas. Por ello, la represión del crimen internacional de piratería marítima continúa siendo una problemática de actualidad. Se desarrolla en este trabajo, primeramente, el concepto del delito internacional que recoge la piratería marítima, así como también la amplia normativa elaborada y aplicada para la represión de este delito. En segundo lugar, la concurrencia de este fenómeno en diversas zonas como son Somalia, el Estrecho de Malaca o el Golfo de Adén. En tercer lugar, se contempla la competencia judicial que tienen los Estados en la persecución de este delito. Y, por último, contempla la regulación del delito de piratería marítima en la legislación española.

[EN]Despite the antiquity of maritime piracy and its consideration as a crime against the law of people, and the repression is the interest of the international community, it has not been eradicated. Nowadays, the problem is not only the quantitative expansion of this crime but, its commission along with other serious illicit actions from the qualitative point of view. For this reason, the repression of the international crime of maritime piracy continues to be a present issue. In this work, we develop the concept of international crime which includes maritime piracy, as well as the extensive legislation developed and applied to the repression of this crime. Second, we watch the occurrence of this phenomenon in different areas such as Somalia, the Straits of Malacca or the Gulf of Aden. Thirdly, we contemplate the judicial competence of States in the persecution of this crime. And, finally, we contemplate the regulation of the crime of maritime piracy in the Spanish legislation.
