LA FIGURA DEL IMPUTADO EN EL PROCESO PENAL

Abstract

[ES]No cabe duda que la figura del imputado es una de las más importantes dentro de un proceso penal. A través del presente trabajo vamos a realizar un estudio sobre esta figura y sobre cómo se llega a adquirir tal condición a través de la imputación, además analizaremos los efectos que conlleva adquirir dicha condición. Por otro lado, haremos un análisis de los cambios que se han producido en nuestra legislación, respecto al imputado, como consecuencia de la adaptación de la normativa Europea a nuestro ordenamiento jurídico, la cual ha introducido algunas novedades que afectan a esta figura. Para terminar haremos un estudio sobre el derecho fundamental que toda persona que se ve sometida a un proceso penal tiene reconocido, el derecho de defensa. Además analizaremos cada uno de los derechos instrumentales, necesarios para que la defensa del investigado sea lo más efectiva y eficaz posible.

[EN]There isn't the slightest doubt that the accused is one of the most important figures in the criminal trial. Through this work we are going to do a study about the accused and how you come to acquire such a condition by imputation, and besides we are going to analyze the effects that the imputation has. On the other hand we are going to do an analysis about the changes that have produced in our legislation about this figure. These changes are a consequence of European regulations that have introduced some novelties in the internal legal system that affect to the accused figure. Finally we are going to study about the right of defense that everyone has recognized when it is in a criminal trial. Also, we will analyzes the instrumental rights that are needed so that the right of defense to be effective.
