EL INTERNAMIENTO DE PERSONAS MAYORES. ESPECIAL REFERENCIA AL TRATAMIENTO AMBULATORIO INVOLUNTARIO

Abstract

[ES]En la sociedad actual existe un envejecimiento progresivo de la población debido a una mayor calidad de vida y al desarrollo de los países industrializados. Este hecho tiene como principal consecuencia la primacía de un sector más vulnerable y mayoritario, la tercera edad. Uno de los problemas que se suscitan es su internamiento, ya sea en un centro geriátrico o psiquiátrico, atendiendo a la deficiencia psíquica o física que se presente. Esta medida, junto con la incapacitación, son las medidas reguladas en nuestro Ordenamiento jurídico para dar protección en esos casos. Pero además de estas, pueden existir medidas alternativas menos lesivas para los derechos de estas personas afectadas. Por tanto, en este trabajo, nos centraremos en el internamiento y su regulación como medida de protección y, sobre todo, en su posible medida alternativa, el tratamiento ambulatorio involuntario.

[EN]In today's society there is a progressive ageing of the population due to a better quality of life and the development of the industrialized countries. Main consequence of this fact is the primacy of a sector more vulnerable and majority, the third age. One of the problems arising is their detention, either in an institution for geriatric or psychiatric, attending to the mental or physical deficiency arising. This measure, together with the disability, are measures covered in our legal system to give protection in such cases. But in addition to these, there may be alternative measures less prejudicial to the rights of these persons. Therefore, in this paper, we will focus in the internment and its regulation as a measure of protection and, above all, its possible alternative measure, involuntary outpatient treatment.
