LA VENTA A PLAZOS DE BIENES MUEBLES

Abstract

[ES]En el presente trabajo se ofrece un estudio de las ventas a plazos de bienes muebles, así como de los distintos contratos que regulan tales ventas, y recopila haciendo una mención especial a aquellos contratos que por ciertos aspectos se podrían entender que están bajo el campo de aplicación de la norma señalada, pero que están excluidos. Igualmente, se recogen los bienes que son objeto de estos contratos, detallando cada una de sus características y también el caso en el que exista una pluralidad de bienes. En el trabajo se analizarán las distintas facultades que van a tener en estos contratos tanto el vendedor como el comprador, así como del ámbito de aplicación de esta ley y su alcance. Por último, cabe mencionar que a lo largo del trabajo también se van a ir haciendo mención a algunas diferencias existentes respecto a la Ley anterior que data del año 1965.

[EN]The current essay offers a study of the sales by instalment of movable assets, as well as of the different contracts that regulate these kind of sales. There is also as especial mention for those contracts that for certain points might be regulated by the stated regulation. Nevertheless, they are excluded. Equally, the assets that are an object of these contracts are mentioned in the essay, detailing each of their characteristics and also the case in which a plurality of assets exists. The essay contains an analysis of the different powers that are available in these contracts, both for the seller and for the buyer, as well as of the area of application of this law and his scope. Finally, it is necessary to mention that the essay contains the differences with regard to the previous Law that dates back of the year 1965.
