LA PRISIÓN PROVISIONAL Y EL INTERNAMIENTO CAUTELAR

Abstract

[ES]En este trabajo se va a realizar un estudio de dos medidas cautelares: la prisión provisional, en el ámbito del derecho penal de adultos y su paralela, la medida de internamiento cautelar en el ámbito del derecho penal de menores, en relación con sus garantías para la afectación lo mínimo posible al derecho de la libertad deambulatoria, estableciendo diferencias y semejanzas de las mismas y considerando por último, las posibles vulneraciones a dicho derecho que se pueden cometer, así como su reparación por parte de la Administración de justicia como responsable de las actuaciones preventivas o cautelares.
