LA RESPONSABILIDAD DE JUECES Y MAGISTRADOS EN EL EJERCIO DE LA JURISDICCIÓN. (RESPONSABILIDAD CIVIL [EXTINTA], PENAL Y DISCIPLINARIA)

Abstract

[ES]El contrapeso a la independencia judicial es la responsabilidad, cuyo fin primordial es garantizar el buen funcionamiento de la actividad jurisdiccional. Para ello el ordenamiento jurídico desarrolló la responsabilidad personal de Jueces y Magistrados en tres niveles: responsabilidad penal, responsabilidad civil y responsabilidad disciplinaria, sin embargo la responsabilidad civil ha sido recientemente derogada tras la reforma de Ley Orgánica 7/2015 de 21 de julio. En este trabajo examinaremos estos tres niveles de responsabilidad además de realizar un breve análisis de la responsabilidad del Estado por el funcionamiento de la justicia.

[EN]The counterweight to judicial independence is responsibility, whose primary purpose is to ensure the proper functioning of judicial activity. For this, the law developed the personal responsibility of judges and magistrates at three levels: criminal, civil liability and disciplinary responsibility, however liability has been recently repealed following the reform of Organic Law 7/2015 of 21 July. In this paper we examine these three levels of responsibility in addition to a small analysis of State responsibility for the operation of justice.
