Abstract

[ES]El presente trabajo trata la violencia de género desde un punto de vista penal, centrándose en cuestiones como qué se considera violencia de género y cuál es el tratamiento penológico que recibe. Para ello, realizo en primer lugar un recorrido social entorno a las causas y efectos de la violencia de género con el objetivo de concienciarnos del recorrido histórico de esta lacra y de cuáles son los factores que la desencadenan. Una vez realizado ese recorrido social, me centro en la problemática penal que se plantea respecto a la violencia de género, centrándome en el ámbito de las lesiones, diferenciando entre violencia de género y violencia doméstica y en el bien jurídico protegido del art.153, así como en el análisis del tipo para determinar si debe concurrir un ánimo subjetivo para la aplicación de dicho artículo y si este debe aplicarse automáticamente en todos los posibles casos de violencia de género en detrimento de otras figuras penales quizás más acordes al caso en concreto.

[EN]This work about gender violence from a criminal perspective, focusing on issues such as what is considered gender violence and what the penological treatment it receives. To do this, I firstly carry out a social journey around the causes and effects of gender violence with the aim of becoming aware of the historical course of this scourge and of what are the factors that trigger it. Once this social journey has been carried out, I focus on the criminal issues that arise with regard to gender violence, focusing on the field of injuries, differentiating between gender violence and domestic violence and the protected legal right of art.153, as well as in the analysis of the type to determine if there should be a subjective mood for the application of this article and whether it should be applied automatically in all possible cases of gender violence to the detriment of other criminal figures perhaps more in line with the specific case.
