La violación de los derechos humanos en Corea del Norte

Abstract

[ES]Con este trabajo, pretendo hacer un análisis sobre la situación de los derechos humanos en Corea del Norte. Para ello, en primer lugar, se presentará brevemente al lector el contexto histórico, político y socioeconómico del país, de modo que se facilite la compresión de las características propias que hacen único a este régimen. En particular, se hará especial hincapié en señalar cuáles son las obligaciones jurídicas contraídas por Corea del Norte en virtud de su adhesión a determinados textos legales pertenecientes al Derecho Internacional. A continuación, se expondrá la difícil situación a la que se enfrentan los refugiados norcoreanos cuando cruzan la frontera norte con China. Posteriormente, se hará referencia a las diferentes tesis y estrategias a seguir adoptadas por la comunidad internacional para lidiar con esta situación. Por último, haré alusión a las vías de actuación existentes actualmente para dirimir el conflicto internacional presente en la península coreana.

[EN]With this paper, I pretend to analyze the Human Rights state of affairs in North Korea. For that purpose, in first place, there will be a brief presentation to the reader about the hystorical, politic and socioeconomic context of the country, therefore it turns easier to comprehend the unique features which turns this regime into one of a kind. In particular, a special emphasis will be made regarding the legal obligations undertaken by North Korea concerning its adherence to certain legal texts belonging to International Law. Afterwards, the difficult situation which North Koreans refugees must face when they cross the northern border with China will be exposed. Subsequently, the different thesis and strategies adopted by the International Community to deal with this situation will be referred to. Last but not least, I will mention the current courses of action to solve the international conflict present in the Korean peninsula.
