La devolución en caliente¿vulneración del sistema de derechos humanos?

Abstract

[ES]En el presente trabajo se tratará de verificar la eventual vulneración de los Derechos Humanos en el territorio español, a causa de la “devolución en caliente” de los inmigrantes procedentes del continente africano, en las ciudades de Ceuta y Melilla. En primer lugar, se hará un recorrido por las diferentes normativas que entran en conflicto con “la devolución en caliente”, desde la normativa internacional, pasando por la europea y acabando por la norma nacional interna española. Posteriormente, se analizará diferente jurisprudencia del Tribunal Supremo, donde se refleja la posición de dicho Tribunal. Finalmente, se analizará los procedimientos de expulsión de inmigrantes que acceden por puestos no habilitados en la frontera de Ceuta y Melilla.

[EN]This paper will try to verify the possible violation of human rights in Spanish territory, due to the "pushbacks" of immigrants from the African continent, in the cities of Ceuta and Melilla. In the first place, a tour of the different regulations that conflict with the pushbacks will take place, from the international regulations, through the European and ending with the national legislation. Subsequently, different jurisprudence of the Supreme Court will be analyzed, which reflects the position of the Court. Finally, we will analyze the procedures for the expulsion of immigrants who enter unlicensed positions on the border of Ceuta and Melilla.
