CONFLICTOS JURÍDICOS EN TORNO A LA VESTIMENTA RELIGIOSA ISLÁMICA

Abstract

[ES]En este trabajo se afrontan los conflictos jurídicos que surgen en torno a la vestimenta religiosa islámica en España y Europa, como consecuencia del creciente movimiento migratorio de tradición musulmana. Se hace una clasificación y diferenciación entre los distintos tipos de prendas objeto del conflicto. La libertad religiosa es un derecho fundamental que hay que respetar dentro de los límites establecidos. Se tienen en cuenta las iniciativas presentadas en España, así como los conflictos en general que surgen en nuestro país, y se compara con la situación europea diferenciando los países con leyes específicas de prohibición para algunos ámbitos y tipos de velo.

[EN]In this work, the juridical conflicts which have appeared in relation to Islamic religious clothing in Spain and Europe will be confronted. It is because of the growing migratory movement of Muslim tradition. A classification and differentiation is made between the different types of garments which causes the conflict. The religious liberty is a fundamental right that the population has to respect inside the settled limits. The initiatives presented in Spain and the conflicts in general will be considered, as well as the conflicts which are being lived currently. The European situation is compared by making a difference among the countries with specific laws of prohibition in some fields and types of veils.
