PROCEDIMIENTO PARA LA CONSTITUCIÓN DE UNA ADOPCIÓN INTERNACIONAL POR AUTORIDAD ESPAÑOLA, EN PARTICULAR CUANDO EL MENOR RESIDE EN EL EXTRANJERO

Abstract

[ES]Este trabajo trata aspectos de un proceso de adopción internacional. Se compone de una introducción, conclusiones, un Anexo y cuatro puntos clave que desarrollan el contenido. Los cuatro puntos señalados, tratan, en primer lugar, la normativa reguladora, que esto se analizará en la legislación aplicable a un proceso de adopción internacional, ya sea de carácter convencional o autónomo. Otro punto es el procedimiento para la constitución de una adopción internacional, donde se detalla tanto la administrativa como la judicial. El tercer aspecto es la especificidad que presenta la adopción internacional, cuando el menor reside en el extranjero, ya que se necesita la cooperación entre Autoridades Centrales. Y, por último, la colocación o traslado del menor a España: toda la normativa existente para proteger al menor en el desplazamiento de su país de origen al país de recepción.

[EN]This essay covers the aspects involved in an international adoption process. It is composed by an introduction, a conclusion, one appendix, and four central sections that will discuss the core issues of this paper. The four indicated sections deals, firstly, with the regulatory standards where all the applicable legislation in an international adoption process, either conventional or regional, will be analyzed. The second section covers the necessary procedure for the constitution of an international adoption process where both the administrative and judicial procedures will be examined. The third one is connected to the specificity which characterizes the international adoption when the minor lives abroad, as cooperation between central authorities is needed. The last section focuses on the placing or transfer of the minor, and the existing regulations that are devised to protect the minor during the displacement from the country of origin to the receiving country.
