LAS MEDIDAS CAUTELARES EN EL PROCESO CIVIL

Abstract

[ES] Las medidas cautelares forman parte del Derecho a la Tutela judicial efectiva previsto en el art. 24.2 de la CE. Evitan que un posible favorable a la pretensión deducida quede desprovista de eficacia como consecuencia de la realización de actuaciones contrarias a derecho por parte del demandado. En el trabajo se hace un análisis pormenorizado de la regulación que hace la Ley de Enjuiciamiento Civil sobre la tutela cautelar.

[EN] The precautionary measures in the civil process reflect the right to effective judicial protection provides for the art. 24.2 of our Spanish Constitution, in order to prevent that a possible favourable failure to the deduced pretension remain devoid of efficiency from carrying out the acts contrary to law by the debtor.
