LA ADOPCIÓN NACIONAL TRAS LA REFORMA INTRODUCIDA POR LA LEY DE 28 DE JULIO DE 2015

Abstract

[ES] En el presente trabajo se hace un examen e interpretación de las últimas reformas operadas en materia de adopción nacional por la nueva Ley 26/2015, de 28 de julio, de modificación de las Medidas de Protección a la Infancia y a la Adolescencia. Se elabora un estudio de cuáles han sido las principales modificaciones respecto a sus requisitos y procedimiento y la incorporación de nuevas figuras jurídicas. Asimismo, se realiza un análisis sobre la determinación del que es el objeto jurídico protegido por esta figura, el interés superior del menor. Por último, aparece una exposición acerca de cuál ha sido la evolución de esta figura jurídica a lo largo de los años y cómo se encuentra regulada en la actualidad tras la reforma en atención a aspectos correspondientes sobre su concepto, requisitos, sujetos intervinientes y etapas de su proceso, haciendo especial referencia a la fase de declaración de idoneidad.

[EN] The present project shows an exam and interpretation about the last reforms operate in the adoption figure by the Law 26/2015, of the 28th of July, about the modification of the Protection Systems for the Childhood and Adolescence. It is done a study relating to analyse which have been the main changes on its requirements and proceeding and the incorporation of new legal figures. In addition, it is also done an analysis about the determination of the legally protected object, the best interest of the child. Finally, it appears an explanation concerned with the evolution of the adoption along the past years and how it is regulated nowadays after the reform in attention to its concept, requirements, parties involved and the steps of its proceeding, focusing on the suitability declaration.
