LA RESERVA VIDUAL, ¿APLICABLES A LAS PAREJAS DE HECHO?

Abstract

[ES] La reserva vidual es una figura clásica del Derecho Civil español muy criticada por doctrina en la actualidad por no adaptarse a las nuevas figuras que han ido surgiendo con el avance de nuestra sociedad. En este trabajo nos centramos en las parejas de hecho las cuales han aumentado considerablemente en los últimos años y a las que esta figura afecta notablemente pues en su dicción literal el artículo 968 Código Civil habla de matrimonio. Esto tiene una fuerte repercusión en los destinatarios de esta figura que son los reservatarios, ya que se van a ver privados de poder gozar de una figura como esta que los proteja ante la libre disposición del conviviente en el caso de que contraiga nuevas nupcias, o establezca de nuevo una pareja de hecho.

[EN] The widow reserve is a classic vidual figure of the Spanish Civil Law criticized by doctrine currentely not adapt to new figures that have emerged with the advancement of our society. In this paper we focus on cohabiting couples which have increased considerably in recent years and that this figure significantly affects its literal wording as in Article 968 Civil Code speaks of marriage.
