VULNERABILIDAD Y DERECHOS: SOBRE LAS MINORÍAS SEXUALES

Abstract

[ES] A lo largo de la historia puede observarse como los grupos vulnerables están presentes y forman parte de ella, siendo posible identificar situaciones de vulnerabilidad al analizar el estado de inclusión social de los mismos. Es a través de esta historia donde se muestra que no siempre ha existido un verdadero interés por proteger a estos colectivos a nivel jurídico; por el contrario nos encontramos con numerosas situaciones de discriminación, rechazo así como falta de preocupación por la integración de estas minorías en la sociedad. La lucha contra la discriminación tiene sus inicios en épocas recientes, ello se hizo especialmente notorio con los textos internacionales sobre Derechos Humanos. En relación a las minorías sexuales, será en pleno siglo XXI cuando se haga referencia expresa a la orientación sexual como causa de discriminación, siendo incluida en el artículo 21 de la Carta de los Derechos Fundamentales de la Unión Europea.

[EN] Throughout history it can be seen as vulnerable groups are present and are part of it, being possible to identify situations of vulnerability to analyze the state of social inclusion of the same ones. It is through this story which shows that has not always has been a real interest in protecting these groups at the legal level; on the contrary we find many situations of discrimination, rejection and lack of concern for the integration of these minorities in society. The fight against discrimination has its beginnings in recent times, it became especially noticeable with international texts on Human Rights. In relation to sexual minorities, it will be in the XXI century where express reference is made to sexual orientation as a basis for discrimination to be included in Article 21 of the Charter of Fundamental Rights of the European Union.
