LOS DERECHOS LABORALES EN LA ANDALUCÍA RURAL. LA MUJER EN LOS CONVENIOS COLECTIVOS DEL CAMPO.

Abstract

[ES] This paper analyses the specific issues of labour law related to the agricultural sector in Andalusia, focusing on the regulation of equality in the collective agreements in the sector. In the first place, a historical analysis of the problem is made in order to understand the circumstances surrounding the agricultural workers. Subsequently, the peculiarities of this sector regarding the general regulation of the labour law are looked over, although we are not facing an independent sector. Finally, the adaptation of the collective agreements to the current regulation concerning gender equality is examined. It is important to note the importance of collective agreements to achieve equal treatment for men and women at work.

[EN] El trabajo analiza la problemática específica del derecho laboral en el sector de la agricultura en Andalucía, haciendo hincapié en la regulación de la igualdad en los convenios colectivos del sector. En un primer lugar, se hace un breve repaso histórico de la problemática para poder entender la coyuntura que rodea en nuestros días a los trabajadores y trabajadoras agrícolas por cuenta ajena. Después se estudia las especialidades del sector respecto a la regulación general del derecho laboral, aunque no nos encontramos ante una rama autónoma del Derecho Laboral. Por último, se analiza partiendo de la regulación vigente en materia de igualdad de sexos, la adaptación de la misma a los convenios colectivos del sector agropecuario. Es esencial tener en cuenta la importancia de los convenios colectivos para lograr la igualdad de trato entre hombres y mujeres en el trabajo.
