EL USUFRUTO COMO LEGÍTIMA DEL CÓNYUJE VIUDO

Abstract

[ES] El presente trabajo de fin de grado centra su estudio en el “usufructo” como derecho real, no obstante hemos querido añadir una pequeña dificultad al hacer referencia al derecho sucesorio; esto se debe a la decisión de estudiar el “usufructo desde el punto de vista de la legítima del cónyuge viudo”. El tema versa en las diferentes cualidades del usufructo viudal, estudiando su origen y haciendo referencia a los diferentes derechos y obligaciones que éste genera entre los sujetos que intervienen en él, llegando a la conclusión de que el mismo establece una excepción al principio de intangibilidad de la legítima, y apreciando que cada vez son más los casos, en los que se apuesta por la conmutación de éste, sin olvidar aquellos otros en los que se puede privar al cónyuge viudo de su derecho.

[EN] This Final Degree Work focuses its study in the "usufruct" as real right, however we have wanted add to a little difficulty to make reference the inheritance law; this must be for the decision about study the "usufruct from the point of view of the legitimate in the widowed spouse ". The theme focuses on the different qualities in the usufruct dower, studying its origin and making reference to different rights and obligations that this generates between subjects that are involved in it, getting to the conclusion that the same establishes an exception at the principle of intangibility of the legitimate, and appreciating that each time they are more cases where bet by the commutation of that, without forget those other in which can deny to the widowed spouse of his right.
