PROTECCIÓN DE ESPECIES SILVESTRES DE LA FAUNA

Abstract

[ES] Se expone un análisis jurídico del art. 334 del CP y de los antecedentes legislativos en la materia, tanto constitucionales como preconstitucionales. El análisis responde a la consideración del tipo recogido en el art. 334 CP como modalidad estereotípica de delitoscontra la fauna haciendo referencia al análisis de la doctrina,jurisprudencia y como la reforma de la LO 1/2015, de 30 de marzo ha afectado a esta tipología de delitos. Se concluye con una comparativa diferencial y otra concursa! entre el art. 334 CP y las demás figuras recogidas en el Capítulo IV que tienen como objeto las especies de fauna, ya sean silvestres o domésticas.

[EN] A legal analysis about art. 334 CP and the legislative history, constitutional and preconstitutional, are displayed. Its mam purpose is the development of the stereotypical criminal behavior reflected in art. 334, as an example of crimes against the wildlife and focusing on the doctrine, the jurisprudence and the last criminal law reform. Finally, the difference between the art. 334 and the other types which protect wildlife and domestic animals too are exposed.
