IDONEIDAD DEL PROFESORADO DE RELIGIÓN CATÓLICA EN LA JURISPRUDENCIA ESPAÑOLA Y DEL TRIBUNAL EUROPEO DE DERECHOS HUMANOS

Abstract

[ES] El trabajo de fin de grado que se va a desarrollar a continuación ofrece una visión sobre la idoneidad del profesorado de Religión católica en España, tanto la otorgación y la revocación, en atención a los pronunciamientos jurisprudenciales y los argumentos doctrinales realizados por los autores sobre este tema. Para ello, parto para su estudio, de la Constitución Española, que es la norma suprema del ordenamiento jurídico español. Aunque toma gran relevancia en este trabajo, el estudio de la jurisprudencia dictada por el Tribunal Constitucional y el Tribunal Europeo de Derechos Humanos, y los comentarios que han hecho algunos autores sobre éstas. Todo ello, tomando en consideración el acuerdo que existe entre el Estado español y la Santa Sede.

[EN] This final degree projects offers an overview on the suitability of Catholic religion Spanish teachers. More precisely, it focuses on granting and revocation concerning the jurisprudential pronouncements and doctrinal arguments made by authors on the issue. To do so, we have thoroughly studied the Spanish Constitution, being the Spanish supreme law. The study of jurisprudence issued by the Constitutional Court and the European Court of Human Rights becomes paramount in this work; in fact, we also devote some lines to comments made by some authors on the issue. The whole review takes into account the agreement between the Spanish State and the Holy See.
