ANÁLISIS DE LA LEGÍTIMA DEFENSA COMO CAUSA DE JUSTIFICACIÓN DEL DELITO

Abstract

[ES] La legítima defensa es una de las eximentes que más se utilizan en nuestra jurisprudencia. El resultado de aplicar la eximente no es otro que eliminar el desvalor de la acción realizada, dado que se justifica su realización. Para la aplicación de la legítima defensa deben concurrir unos requisitos determinados que hacen que el legislador justifique la acción. Este trabajo analiza las características esenciales de la eximente, además se trabaja con la jurisprudencia tanto de sentencias históricas como de las actuales, en las que la legítima defensa se aplica de forma completa e incompleta, variando así el resultado que produce la aplicación de la eximente.

[EN] Self-defense is one of the most commonly used exculpatory circumstances in our jurisprudence. The result of applying the exculpatory circumstance is simply to remove the impairment of value of the action taken and justifying it. For the application of selfdefense certain requirements must be met that make the legislator justify the action. This essay analyses the essential characteristics of the self-defense circumstance working with jurisprudence from both historical rulings and current ones. In these rulings self-defense applies in a complete or incomplete way, thus varying the result produced by the application of the exculpatory circumstance.
