MODIFICACIÓN DE LOS DELITOS MEDIOAMBIENTALES Y SU DELIMITACIÓN ADMINISTRATIVA- PENAL EN UN CASO DE RESIDUOS PELIGROSOS

Abstract

[ES] Se analiza jurídicamente la situación de los delitos medioambientales en el CP e influencia del derecho administrativo, teniendo en cuenta la modificación realizada recientemente por la LO 1/2015 y 2/2015. Se estructura en tres apartados, siendo el primero una comparativa de los CP de 2010 y el vigente, el segundo bloque se aborda la fundamentación de la administrativización del derecho penal medio ambiental y, por último, se expone un caso hipotético donde se muestra las diferentes problemáticas de concurrencia administrativa y penal, exponiendo soluciones por la autora de este estudio

[EN] Legally analyzes the situation of environmental crime in the CP and influence of administrative law, taking into account the modification carried out recently by the the 1/2015 and 2/2015. It is divided into three sections, being the first a comparison of the CP of 201 O and the current, second block deals with the Foundation of the administrative of environmental criminal law and, finally, described a hypothetical case which shows the various problems of concurrence of administrative and criminal, exposing solutions by the author of this study
